Govt. Revises Legal Metrology (Packaged Commodities) Rules 2011

In exercise of the powers discussed in section 52 of the Legal Metrology Act 2009, the Central Government made various rules to be revised under the Legal Metrology (Packaged Commodities) Rules, 2011. This article caters the key points revised by the Government of India to be amended under the law:

  1. Ministry of Consumer Affairs, Food & Public Distribution under the administration of the Department of Consumer Affairs has revised the Legal Metrology (Packaged Commodities) Rules 2011. It will now be named as Legal Metrology (Packaged Commodities) Amendment Rules, 2021. The rules shall come into force from 1st April 2022.
  2. A new provision has been initiated to indicate the unit sale price on pre-packed commodities, which will allow a simpler comparison of the prices of the commodities at the time of purchase.
  3. Consumer Affairs under the Ministry of Consumer Affairs, Food & Public Distribution has removed Rule 5 of the Legal Metrology (Packaged Commodities), Rules 2011 defining the Schedule II proposing the pack sizes of different types of commodities.
  4. Earlier, the package had to display the year and month in which the product was manufactured, pre-packed, or imported. To clarify the misunderstanding and make the system more systematic, officials from organizations and industries have been addressed. For prepacked goods, the disclosure of date has now been restricted to the month and year when the product was made. This hereby decreases the compliance burden and eradicates the ambiguity of date declaration for customers
  5. The rules for listing pre-packaged goods in numbers have been abridged to make it simpler to comply for manufacturers, packers, and importers. Before, such claims could only be indicated by the letter’s 'N' or 'U.' Now the amounts can be labelled as a number, pair, unit, piece, set, etc. that defines the package quantity. This shall eradicate the uncertainty nearby the reporting of the amount sold by number in prepackaged goods.
  6. Now the unit sale price shall be declared as:
    • -Rs. __ per g | for pre-packaged commodities with net quantity of commodity less than one kilogram;
    • -Rs. __ per kg | for pre-packaged commodities with net quantity of commodity more or equal to one kilogram;
    • -Rs. __ per cm for pre-packaged commodities with net length of the commodity less than one meter
    • -Rs. __ per meter | for pre-packaged commodities with net length of the commodity more or equal to one meter;
    • -Rs. __ per number |
    • -Rs. __ per ml | for pre-packaged commodities with net volume of the commodity less than one litre;
    • -Rs. __ per litre | for pre-packaged commodities with net volume of the commodity more or equal to one litre.

As per the new notification, the department has put an extension on the implementation of Legal Metrology Packaged Commodity Amendment Rules 2021 or new amended rules till October 1st, 2022.
