Legal Metrology Registration

The Legal Metrology Act, 2009 (‘LMA’) was introduced in order to safeguard consumer interest and rights. Effective from April 01, 2011, LMA establishes and enforces standards for packaged products. Legal Metrology Registration law is applicable to all packaged products which are manufactured/imported and sold in ‘packed form’ in the Indian market.

Legal Metrology registration can be applied in two capacities:

  • Manufacturer/Packer
  • Importer

Products which pertain to the “weight & measures” category like weighing machine, thermometer, fall under the category of weight & measurement which needs to take four different registrations from the Legal Metrology department, i.e.

  • Model Approval
  • Packaged Commodity Registration
  • Import License
  • Dealership License

Products that are not falling under the category of the “Weight & Measurement” category need to take only ‘Packaged Commodity’ Registration from the department.

  • Model Approval: It is applicable only on products fall underweight & measurement category. This registration shall be granted by the central Government. We need to submit the sample in the lab to test if it is according to Indian standards or not.
  • Packaged Commodity Registration: This is applicable to all the packaged commodities, which are to be retailed to end consumers. Manufacturer/Importer need to provide relevant product information on packaged goods. This information needs to follow the guidelines defined in the rule. This Registration shall be granted by both state and central government. 
  • Import License: Once model approval is done we have to apply for Import License for that approved model from the Legal Metrology Department. This registration shall be granted by the state government where the goods will be imported.
  • Dealership License: If the importer is importing a product and selling it with the same brand name then he must get the dealership license from the Legal Metrology Department. The Dealership registration shall be granted by the central/state government where the company is registered.

What is the Law under Legal Metrology Act?
A

Legal Metrology treats units of weighment and measurement, methods weighment and measurement and weighing and measuring instruments in relation to the mandatory technical and legal requirement which have the object of ensuring public guarantee from the point of view of security and accuracy of weighment and measurement.
In order to ensure uniform enforcement of laws related to matters in Legal Metrology throughout the country, the Govt. has enacted: 

(1) The Legal Metrology Act, 2009
(2) The Legal Metrology (Packaged Commodities) Rules, 2011
(3) The Legal Metrology (General) Rules, 2011, and 
(4) The Meghalaya Legal Metrology (Enforcement) Rules,2011.

Who is competent authority to grant license?
A

Controller of Legal Metrology Department is the competent authority to grant the licence. Application for licence should be submitted to the Inspector of Legal metrology who will inspect the firm and forward the same to Controller of Legal Metrology with recommendation for consideration.

What are commodities covered under the Rules?
A

All pre-packaged commodities except otherwise exempted from the rules are covered under the Rules. The exemption is given for Druges, fast food items and packaged commodities sold in the packages upto 10g or 10ml.

Can a person use unstamped weights or measures?
A

No, weights or measure shall be sold or offered, exposed or possessed for sale or used or kept for use in any transaction or for protection unless it has been verified & stamped that too by a licenced manufacturer/dealer of Legal Metrology Officer.

How can consumer ensure weight and measure standard?
A

Every weight & measures is manufactured as per the specification and model laid down by the Govt. of India. Weight & measures used by the traders are verified & stamped by the Inspector of the Legal Metrology Department, after due verification, with a seal for ensuring the integrity of the stamp of Inspector and quarter in which it is verified.

What is Pre-Packaged Commodity?
A

Pre-packaged commodity" means any commodity which, is placed in a package without the purchaser being present, of whatever nature, whether sealed or not, so that the product contained therein has a pre-determined quantity is a pre-packed commodity.

Is Legal Metrology rules applicable to imported Packages?
A

Yes, the Rules are applicable both to imported Packages as wells as the indigenous packages.
