Highlights of theLetter regarding clearing of consignments related to import of base oil or lubrication oil 

1. MoEFCC notified HWM, 2nd Amendment Rules, 2023 on 18th September 2023 for the management of Used Oil through EPR framework.

2. The Producers (who includes the Importers) are required to obtain the EPR registration from CPCB portal, who are involved in 

a. import of Base Oil

b. Lubrication Oil 

c. Other Oils (used as lubricants) 

3. CPCB will launch an Oil EPR Portal by May, 2024.

4. Until the Portal is Launched imported consignments shall be released by Customs for the following categories of Oil:

a. Base Oil (under the HS Code — 2710 1971),

b. Lubrication Oils (under the HS Codes - 2710 1972 to 2710 1990), and 

c. Other oils (used as lubricant- under the HS Codes - 2710 9100, &2710 9900).

5. Declaration format is enclosed in the Notification and the same shall be submitted to CPCB at prusedoil.cpcb@gov.in  

“baseoil” means any oil used for production of finished lubrication oil  

“producer” means any person or entity, irrespective of the selling technique used such as dealer, retailer, e-retailer, who, - 

(i) manufactures and offers to sell base oil or lubrication oil domestically under its own brand; or

(ii) offers to sell lubrication oil domestically under its own brand, using the base oil manufactured by other manufacturers or suppliers; or

(iii) offers to sell imported base oil or lubrication oil domestically;

The following entities shall get them registered by the Central Pollution Control Board on the portal,namely:-  

(a) producers;

(b) collection agents

(c) recyclers

(d) used oil importers.
